During a recent event, Justice BV Nagarathna emphasised that neither the judiciary, executive, nor legislature holds supremacy; instead, it is the Constitution of India that reigns supreme. She stressed that the independence of the judiciary is a cherished ideal enshrined in the Constitution and that judges value it greatly. While the government cannot question the court’s decisions, the court, in turn, should not question the wisdom of the legislature.
Justice Nagarathna highlighted that the founding fathers of the Constitution regarded socio-economic justice as a central idea. Additionally, the notion of liberty remains of significant importance today, and there is room for further interpretation of rights within the fundamental rights enumerated in the Constitution. However, she emphasised that this expansion depends on how well the legal profession assists the courts.
The judge urged the people of India to ensure that liberty remains a guiding principle and took note of the importance of fraternity, which she believed is often least understood. Emphasising the need to deepen democratic values, she encouraged embracing the values of the Indian Constitution, which bind citizens together despite religious, linguistic, and other differences.
Justice Nagarathna also expressed concern over corrupt practices and the signs of lack of integrity, such as bribery and the accumulation of disproportionate assets. She urged individuals to shun benefits obtained through ill-gotten money and to focus on being ideal citizens rather than being consumed by consumerism.
In conclusion, the judge quoted Justice Chinnappa Reddy, who emphasised the importance of preserving tolerance in Indian traditions, philosophy, and the Constitution, urging everyone not to dilute this essential virtue.
